The E-Evidence Package

The so-called E-Evidence Package consists of a regulation and a directive and establishes the first EU-wide framework for cross-border access to electronic evidence in criminal proceedings.

The E-Evidence Regulation (EU) 2023/1543 sets out the substantive legal provisions governing production and preservation orders (EPOC and EPOC-PR). As a regulation, it is directly applicable and does not require transposition into national law.

Implementation of the Directive

The situation is different for the accompanying Directive (EU) 2023/1544, which governs the designation of establishments and legal representatives. This Directive must be transposed into national law in the Member States and also regulates, for example, which authorities are responsible as central authorities or enforcement authorities.

Transposition should have been completed in all EU Member States (except Denmark) by 18 August 2026, but this has not happened.

‘Technical Readiness’

Furthermore, the E-Evidence Package is distinctive in that it involves not only legal instruments but also requires a decentralised IT system (e-Codex) to be operational, through which service providers can receive orders and send responses to the authorities. The fact that an implementing law has been passed does not necessarily mean that an EU Member State is technically capable of ensuring that companies registered there can receive disclosure or preservation orders.

Companies can communicate with the decentralised IT system via a web interface or an application programming interface (API). If a country enables communication via a web interface, this does not necessarily mean that communication via an API is also possible. However, those who opt for communication via API – which is the case for users of the EviGate platform – can only receive orders once the API is operational and has been tested. In this instance, orders cannot be served via the web interface either.
